Competition legislation in the EC is continuously evolving with the Commission and Member States having agreed to review a number of the existing provisions.

We generally welcomed the Commission’s initiative to modernise the current Block Exemption Regulation with a view to simplifying it and making it clearer. The more flexible approach introduced was particularly welcome including the limited number of block clauses.

Orgalime issued position papers in 2002 and 2003 on the reform of the transfer of Technology Block Exemption Regulation and organised meetings with officials from DG Enterprise and DG Research. We commented on the use of market thresholds which is often problematic for the engineering industry, where innovative companies often have high market shares in a niche market when launching a new and innovative product.

Due to the changes in legislation, Orgalime has also produced a guide on the EU’s Competition Policy and issued a updated version of the Orgalime Model Form for and an International Technology Licence agreement; please see our Publications section for further information.
