Orgalime’s Legal Affairs Working Group brings together the heads of the legal departments from Orgalime members throughout the EU, and focuses on two work streams:

 

1. Preparation of publications to be used by companies in their daily business.

Orgalime’s legal publications are drafted by the heads of the legal departments of Orgalime’s member associations. There are three types of legal publication: General Conditions, Model Forms of Contract and Guides. The standardised General Conditions enhance the security of transactions, simplify negotiation, and support the drafting of contracts and contract relations.  The most popular General Conditions are the Orgalime S 2012 for the Supply of Mechanical, Electrical and Electronic Products, and the SI 14 for the Supply and Installation of Mechanical, Electrical and Electronic Products. Orgalime’s legal publications provide companies with a model for each ‘business case’ in B2B relations (e.g. product supply, product installation, repair, maintenance etc.). Licensing Companies that would like to attach an electronic version of Orgalime’s General Conditions to their tenders and contracts when emailing their customers and suppliers need to obtain a license. Orgalime’s licensing agreements can be obtained through our website.

 

2. Preparation of position papers concerning EU legislation.

The Legal Affairs Group focuses on issues affecting our industry as a whole in B2B relations, as well as covering competition law and product liability. Ongoing issues include:

· Common European Sales Law

· Competition legislation

· Data protection

· European Community Patent

· European Private Company

· IPR protection and European patent policy - anti-counterfeiting

· Public procurement
