Marking requirements of article 10(3) and article 11 (2) of Directive 2002/96/EC (WEEE)

In the course of the transposition of the WEEE directive into national law, European standardisation bodies will be mandated to draft a harmonised standard to fulfill the marking requirements of the Directive. In this context, the present position paper is addressed to the authorities involved. We believe that the requirement of preventing waste from electrical and electronic equipment from entering the municipal waste stream and the requirement of marking an appliance in order to certify that it represents a 'new appliance' could be both fulfilled by one single marking, i.e. the 'crossed out wheeled bin' with the added reference to Directive 2002/96/EC below. For exceptional cases, the possibility of printing the crossed out wheeled bin on the packaging should be considered as an alternative.

Concerning the requirement of producer identification, Orgalime calls for a transparent process as the directive covers an enormous range of products where particularities (such as size, unit costs, etc.) need to be considered. Orgalime believes that the introduction of independent marking requirements by member state authorities should be prevented.
